SALE AGREEMENT

1.1. These online terms and conditions of sale (“Agreement”) apply to all products (“Products”) purchased via Elevate Your Style with Timeless Luxury: Pringle of Scotland – Namibia Pringle (“Website”) from Gazania Investments Three Hundred and Eighty One (Pty) Ltd trading as Pringle of Scotland (“we” or “us”) whose registered office is Unit 3, 2nd Floor, Ausppann Plaza, Dr Agostinho Neto Road, Ausspannplatz, Windhoek, Namibia.

1.2. The references to “you” refer to you being the individual person or juristic person to whom we market or supply the Products. You must be 18 (eighteen) years or older to enter into this Agreement or you must be assisted by your legal guardian.

1.3. This Agreement will apply to any Products bought via the Website and it will come into effect and become legally binding when we have received your order via the Website (“Order”) and payment in respect thereof and have accepted the Order by confirming your Order and issuing you with an order confirmation (“Order Confirmation”) via email.

1.4. Please note that placing your Order does not mean an acceptance of your Order. It must first be confirmed by us and all Orders are subject to availability of stock and receipt of payment.

1.5. The current Agreement in place at the time of the Order will be the Agreement applicable to your Order. We reserve the right to vary or amend the terms of this Agreement from time to time with regards to future Orders.

PRODUCTS AND PRICES

2.1. The images of the Products on the Website are for illustrative purposes only and may differ from the actual Products.

2.2. The Product prices are inclusive of the valued added tax and are as displayed on the Website at the time of the Order. These prices exclude delivery charges, which (where applicable depending on the value of the Order) will be displayed on the Website when you checkout and select pay.

2.3. We reserve the right to change the prices of the Products on the Website, from time to time, without prior notice. While we will do our best to ensure the accuracy of the prices displayed, we will not be liable for prices that are obviously incorrect or have been amended without our authorisation. In this instance, we will contact you to confirm whether you would still like to Order the item at the correct price.

2.4. Online exclusive sale prices are available to Pringle of Scotland online shoppers only and does not affect prices in other stores.

PLACING YOUR ORDER

3.1. Select the Products you wish to purchase by adding them to your cart. When you are finished shopping, select checkout and once you are happy with your Order and have provided all the required information (including the payment method), select pay and you will be re-directed to the applicable payment site.

3.2. Your Order Confirmation will be sent to you via email and the original invoice will accompany your delivery. You will be able to track your Order via our delivery company’s tracking mechanism as advised to you.

RISK AND OWNERSHIP

All risk in and to all Products shall pass to you upon successful delivery. Ownership in the Products shall remain vested in us until the full purchase price has been paid and received by us.

COOLING OFF PERIOD

7.1. In terms of the Electronic Communications and Transactions Act, if you are a natural person (meaning an individual and not a juristic person or a company), you are entitled to cancel your Order for the Products purchased via the Website, without reason and without penalty, within 7 (seven) days of the Products having been delivered to you. To exercise your cooling-off right you must notify us in writing at helpme@frontierco.co.za within 7 (seven) days of delivery.

7.2. If you elect to exercise this cooling-off right, you:

7.2.1. will receive a full refund of the price paid by you for the Products within 30 (thirty) days of the date of cancellation. You may be liable for the direct costs of returning the Products to us, such as returning the Products via courier and/or shipping charges; and

7.2.2. undertake not to utilise the Products and return the Products in the original and unopened packaging.

LEGAL MATTERS

9.1. The physical address provided by you when ordering Products on the Website shall be your domicilium address for all purposes in terms of this Agreement, for the giving of any notice, and the serving of any process. Our chosen domicilium address is set out in clause 1.1 above.

9.2. A notice in terms of this Agreement shall be presumed to have been duly given if delivered by hand, on the date of delivery and if sent by post, 7 (seven) days after posting.

9.3. This Agreement represents the entire agreement between Pringle of Scotland and you. No amendment to this Agreement shall be of any force and effect unless reduced to writing and agreed by you and Pringle of Scotland .

9.4. This Agreement shall be governed and construed in accordance with the laws of South Africa and you hereby consent and submit to the jurisdiction of the courts of South Africa.

 

REFUND AND RETURN

You may be eligible for an exchange or refund up to 14 (fourteen) days from the receipt of your shipment.

We cannot accept returns of worn, damaged products, personalised or otherwise non-saleable products.

We will gladly exchange your purchase if the product is in stock or for an item of similar or greater value.

For online refunds, your purchase must be returned to our warehouse in their original condition and packaging and will be subject to the inspection of the returned item which will be refunded if the conditions are met. Cost of the transport for the refund will be for your account, unless it is found to be a manufacturing defect or if you received an incorrect item.

If the goods have been approved for return, we will contact you and arrange for our couriers to collect the item from you.

In the event that you prefer to use your own courier company or to post the goods we will only accept responsibility once we physically receive the goods at our Pringle of Scotland store at The Grove Mall. Goods need to be sent to our Pringle of Scotland store at The Grove Mall marked for the attention of the Pringle of Scotland online store. In the event that you elect to return the goods to us via this channel all risks will be for your account. If the postal service or courier company (other than our own courier company) loses the returned parcel the onus will be on the sender to resolve the issue of the lost parcel.

Please package all returned goods carefully so that the item does not become damaged en-route. Please include the original invoice.

Shipping & Delivery

DELIVERY INFO

We offer an awesome delivery service by partnering with a reputable courier to deliver your Order directly to your door. This allows you to shop anywhere, at any time at your convenience. WE DELIVER FREE all over Namibia On ALL orders over N$999. If your Order value is less than N$999 the delivery fee will be confirmed at the final Order Confirmation stage.

We have a central Pringle of Scotland store at The Grove Mall, this allows us to get your Order out ASAP, between 3 – 5 working days, except during sales and special events when delivery may take up to 10 (ten) working days. If we anticipate longer delays, we will let you know. All Orders placed on weekends will be processed on the following Monday.

Deliveries are only made to valid addresses within Namibia, on business days only.
You or a person authorised to accept delivery on your behalf must be available during normal business hours at the delivery address specified in the Order Confirmation (“Delivery Address“). Any person accepting delivery of the Products may be required to produce a form of identification.

If we are unable to deliver your Order within 15 (fifteen) days of your receipt of an Order Confirmation, we will contact you and either process a refund immediately or arrange the delivery of another product, of the same value.

 

TRACKING

Once your Order has been shipped you will receive an email confirmation containing your shipping details, as well as a tracking number.
